If there is any conflict between the policies in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. Ecwid will inform an individual of the purpose for which it collects and uses information and the types of non-agent third parties to which Ecwid discloses or may disclose the information.

Processing purposes and respective legal basis Provision of the website; communication
The website requires the handling of personal data, such as the IP address for providing the contents displayed on the website, for requests made by you or for our Services.

We collect and store the following information:

Information you give us to contact you, including, contact information, such as your name, company name, address, phone number, email address, and similar contact data;
Automatic information, such as computer sign-on data, browser type, browser language, statistics on page views, traffic to and from our user interfaces and ad data. Your interest in confidentiality weighs less in both cases. We may not otherwise provide this website to you or respond to your contact request.

You can register an account with us. This necessitates personal data such as contact and identity information, access credentials such as passwords, password hints, and similar security information used for authentication and account access.

Once you register on Ecwid.com, you are no longer anonymous to us.

These communications are part of your relationship with Ecwid and you receive them as part of the Ecwid membership. The handling of your personal data within the scope of the registered account is carried out for the performance of the corresponding user contract.

As part of your registration on our website to use the Services, our website, you agree that you may receive certain administrative communications from us, such as administrative announcements and customer service messages regarding Services and products during the period that we provide Services to you. You may not opt out of receiving such administrative communications.

If you choose to use the Services, we may require you to provide contact and identity information, billing information, and other personal information as indicated on our user interfaces, including on Ecwid.com.

We do not store the following information in the regular course of our business:

credit card information and billing addresses.
Data processing with your consent

If you have given us your consent to process personal data for certain other purposes (e.g. sending the newsletter), the data will be processed on the basis of this consent. Ecwid provides details on the contents when requesting the consent. Consents are always voluntary. If the processing of personal data is based on a consent given by you, you have the right to revoke this consent at any time. This also applies to consents given to us prior to the validity of the GDPR, i.e. before 25 May 2018. You can also withdraw your consent by sending an e-mail to privacy@ecwid.com.

The legality of data processing prior to withdrawal remains unaffected by your withdrawal.

The legal basis for data processing based on consent is Art. 6 Para. 1 a) GDPR.

Newsletter
Our newsletter is used as a general means of communication and may include updates to the Services as well as new partner agreements. You have the option to unsubscribe to our newsletter at anytime.

If you have expressly consented to receive newsletters, your declaration of consent is as follows:

Information We Share
We share your personal information with your consent or as necessary to provide the Services. In addition, we share personal information with vendors or agents to provide the Services. For example, companies we’ve hired to provide customer service support may need access to personal information in order to provide those functions. In such cases, these companies must abide by our Privacy Policy and security requirements and are not allowed to use personal information they receive from us for any other purpose. We commission an external service provider with tasks in the area of payment services as data processor for the purposes described herein. The service provider has been carefully selected by us and is regularly monitored, in particular with regard to the careful handling and protection of personal data accessible to them. We oblige all service providers to maintain confidentiality and to comply with legal requirements. In cases of onward transfer to third parties of data of EU or Swiss individuals received pursuant to EU-US or US-Swiss Privacy Shield, Ecwid is potentially liable. We will access, transfer, disclose, and preserve personal information, when doing so is necessary to: (i) comply with applicable law or respond to valid legal process, including from law enforcement or other government agencies.

Do Not Track
Ecwid does not support Do Not Track technology.

Cookies

Accessing, Reviewing and Changing Your Personal Information
If you are registered to receive the Services, you have the right to access, review and modify your personal information at any time by logging into your Profile page located at https://my.ecwid.com. If you cannot access personal information collected by Ecwid by the a foregoing link or through the Ecwid services, you may contact Ecwid at the address above and Ecwid will respond to requests to access or edit your personal information.

You have the right to object at any time on grounds arising from your particular situation to the processing of personal data concerning you on the basis of Article 6(1)(e) GDPR and Article 6(1)(f) GDPR. If you object, we will no longer process your personal data unless we can prove compelling legitimate reasons for the processing that outweigh your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.

If you are of the opinion that the processing of your personal data violates legal requirements, you have the right of appeal to a data protection supervisory authority responsible for us.

In compliance with the EU-US and US-Swiss Privacy Shield Principles, Ecwid commits to resolve complaints about your privacy and our collection or use of your personal information. European Union and Swiss individuals with inquiries or complaints regarding this privacy policy should first contact Ecwid at legal@ecwid.com.

Ecwid has further committed to refer unresolved privacy complaints under the EU-US and US-Swiss Privacy Shield Principles to the BBB EU PRIVACY SHIELD, a non-profit alternative dispute resolution provider located in the United States and operated by the Council of Better Business Bureaus. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit www.bbb.org/EU-privacy-shield/for-eu-consumers/ for more information and to file a complaint. Please note that if your complaint is not resolved through these channels, under limited circumstances, a binding arbitration option may be available before a Privacy Shield Panel. We may amend this Privacy Policy at any time by posting the amended terms on Ecwid.com. In the event of amendment, all terms shall take effect thirty (30) days after initial posting to Ecwid.com.
